H-1B Visa is an employment based nonimmigrant visa classification which permits a foreign national to work in the United States for a temporary period in specialized occupation. A person may hold H1B status for three years, extendable to a total of six years. In order to qualify for the H-1B visa classification, a foreign national must have a minimum of a bachelor’s degree (or equivalent) and the offer of employment must be for a related specialized occupation which requires a minimum of a bachelor’s degree.
H-1B cap cases can be filed on the beginning of April (April 1st) for each fiscal year. There are 65,000 regular H1B cap numbers plus 20,000 advanced-degree cap exemptions (master's cap) available per year.
